ผู้ขนส่งจะต้องรับผิดต่อคนโดยสารในความเสียหายอันเกิดแก่ตัวเขา หรือในความเสื่อมเสียอย่างใด ๆ อันเป็นผลโดยตรงแต่การที่ต้องชักช้าในการขนส่ง เว้นแต่การเสียหายหรือชักช้านั้นเกิดแต่เหตุสุดวิสัยหรือเกิดแต่ความผิดของคนโดยสารนั้นเอง

English translation
The carrier is liable to a passenger for injury caused to that passenger, and for any loss which is the direct consequence of delay in the carriage, unless the injury or the delay was caused by force majeure or by the fault of the passenger himself.
