Lorsqu'une personne ayant acquis antérieurement un bien hypothéqué est privée de ce bien par la mise en œuvre ou la radiation d'une hypothèque, cette privation de propriété est sans effet rétroactif et les droits préférentiels enregistrés par ses propres créanciers du débiteur hypothécaire ou de tout autre ancien propriétaire sont maintenus. Dans ce cas, si des droits sur le bien hypothéqué, existant en faveur ou à l'encontre de la personne ayant acquis antérieurement ledit bien, ont été éteints par fusion au moment de son acquisition, ils reprennent effet après la privation de propriété.
