Un agent commissionné chargé de vendre ou d'acheter un bien coté en bourse peut être lui-même l'acheteur ou le vendeur, sauf stipulation contraire expresse dans le contrat. Dans ce cas, le prix à payer est déterminé par la cotation du bien en bourse au moment où l'agent commissionné notifie sa qualité d'acheteur ou de vendeur. À réception de cette notification, le mandant est réputé avoir accepté la transaction, à moins qu'il ne la refuse immédiatement. L'agent commissionné peut même, dans ce cas, percevoir une rémunération.
