Article 121 — Reading back and signing testimony

ในการนั่งพิจารณาทุกครั้ง เมื่อพยานคนใดเบิกความแล้ว ให้ศาลอ่านคำเบิกความนั้นให้พยานฟัง และให้พยานลงลายมือชื่อไว้ดังที่บัญญัติไว้ในมาตรา ๔๙ และ ๕๐ความในวรรคหนึ่งไม่ใช้บังคับกับกรณีที่มีการใช้บันทึกถ้อยคำแทนการเบิกความของพยานตามมาตรา ๑๒๐/๑ หรือมาตรา ๑๒๐/๒ หรือกรณีที่มีการสืบพยานโดยใช้ระบบการประชุมทางจอภาพตามมาตรา ๑๒๐/๔ หรือกรณีที่มีการบันทึกการเบิกความของพยานโดยใช้วิธีการบันทึกลงในวัสดุ ซึ่งสามารถถ่ายทอดออกเป็นภาพหรือเสียงหรือโดยใช้วิธีการอื่นใดซึ่งคู่ความและพยานสามารถตรวจสอบถึงความถูกต้องของบันทึกการเบิกความนั้นได้ แต่ถ้าคู่ความฝ่ายใดฝ่ายหนึ่งหรือพยานขอตรวจดูบันทึกการเบิกความของพยานนั้น ให้ศาลจัดให้มีการตรวจดูบันทึกการเบิกความนั้น

At every sitting, when a witness has testified, the court shall read the testimony to the witness and have the witness sign it, as provided in Sections 49 and 50.
The provision in paragraph one shall not apply where a written statement is used in place of the witness's testimony under Section 120/1 or Section 120/2, or where the evidence is taken by a video conference system under Section 120/4, or where the witness's testimony is recorded onto a medium that can reproduce images or sound, or by any other method by which the parties and the witness can verify the accuracy of that record of testimony. But if a party or the witness requests to inspect the record of the witness's testimony, the court shall arrange for the inspection of that record of testimony.

Section 121 states the traditional safeguard that a witness's testimony is read back and signed, incorporating the recording rules in Sections 49 and 50, so that the written record accurately reflects what was said. The second paragraph carves out the modern methods introduced elsewhere in Chapter 2: pre-filed written statements under Sections 120/1 and 120/2, video conference evidence under Section 120/4, and audio-visual or other verifiable recordings, none of which need the read-back because accuracy is secured by other means. To preserve the witness's and parties' control over the record, a right to inspect the recording is retained. The provision thus reconciles the older signing formality with the electronic recording of proceedings.
