เมื่อคู่ความฝ่ายใดอ้างอิงเอกสารฉบับใดเป็นพยานหลักฐานและคู่ความอีกฝ่ายหนึ่งคัดค้านเอกสารนั้นตามที่บัญญัติไว้ในมาตรา ๑๒๕ ถ้าต้นฉบับเอกสารอยู่ในความครอบครองของคู่ความฝ่ายที่อ้างเอกสาร ให้คู่ความฝ่ายนั้นนำต้นฉบับเอกสารมาแสดงต่อศาลในวันสืบพยาน ไม่ว่าเวลาใด ๆ ก่อนมีคำพิพากษา ถ้าศาลได้กำหนดให้คู่ความฝ่ายที่อ้างเอกสารส่งต้นฉบับต่อศาล โดยที่ศาลเห็นสมควร หรือโดยที่คู่ความอีกฝ่ายหนึ่งยื่นคำขอ ให้คู่ความฝ่ายนั้นส่งต้นฉบับเอกสารต่อศาล เพื่อศาลหรือคู่ความอีกฝ่ายหนึ่งจะตรวจดูได้ตามเงื่อนไขซึ่งจะได้กำหนดไว้ในกฎกระทรวงว่าด้วยการนั้น หรือตามที่ศาลจะได้กำหนด แต่
(๑) ถ้าไม่สามารถจะนำมาหรือยื่นต้นฉบับเอกสารดังกล่าวข้างต้น คู่ความฝ่ายนั้นอาจยื่นคำขอโดยทำเป็นคำร้องต่อศาลในวันหรือก่อนวันที่กำหนดให้นำมาหรือให้ยื่นต้นฉบับเอกสารนั้น แถลงให้ทราบถึงความไม่สามารถที่จะปฏิบัติตามได้พร้อมทั้งเหตุผล ถ้าศาลเห็นว่าผู้ยื่นคำขอไม่สามารถที่จะนำมาหรือยื่นต้นฉบับเอกสารได้ ศาลจะมีคำสั่งอนุญาตให้นำต้นฉบับเอกสารมาในวันต่อไป หรือจะสั่งเป็นอย่างอื่นตามที่เห็นสมควรเพื่อประโยชน์แห่งความยุติธรรมก็ได้ ในกรณีผู้ยื่นคำขอมีความประสงค์เพียงให้ศาลขยายระยะเวลาที่ตนจะต้องนำมาหรือยื่นต้นฉบับเอกสารนั้น คำขอนั้นจะทำเป็นคำขอฝ่ายเดียวก็ได้

When any party cites a document as evidence and the other party objects to that document as provided in Section 125, if the original document is in the possession of the party citing the document, that party shall produce the original to the court on the day of taking evidence, at any time before judgment. If the court has directed the party citing the document to submit the original to the court, whether because the court considers it appropriate or because the other party has filed an application, that party shall submit the original to the court so that the court or the other party may examine it, under the conditions prescribed in the ministerial regulation on that matter or as the court may prescribe. However,
(1) If the above original document cannot be brought or submitted, that party may file an application, made in the form of a motion, to the court on or before the day fixed for bringing or submitting the original, stating the inability to comply together with the reasons. If the court is of the opinion that the applicant is unable to bring or submit the original, the court may order that the original be brought on a later day, or may order otherwise as it considers appropriate in the interest of justice. Where the applicant merely wishes the court to extend the time within which it must bring or submit the original, the application may be made ex parte.
(2) If bringing or submitting the original to the court would cause loss or damage, or an obstruction by a significant impediment or any grave difficulty, the party citing the document may file an ex parte application, made in the form of a motion, to the court on or before the day of taking evidence, stating such loss, impediment, or difficulty. If the court is of the opinion that the original cannot be brought or submitted to the court, the court may order that the original be submitted at any place, before any official, and under any conditions as it considers appropriate, or may order that a certified true copy of the whole or only the relevant part be submitted in lieu of the original.

Section 122 sits in Chapter 3 on documentary evidence and fixes the duty of the party who cited a document to produce its original once the opponent objects under Section 125. Production must occur at the hearing, before judgment, and the court may also order the original submitted for inspection under a ministerial regulation or its own conditions. Paragraphs (1) and (2) provide relief valves: (1) for a party who cannot bring the original in time, who may seek an extension or other order, and (2) where production itself risks loss, damage, or serious difficulty, allowing submission elsewhere or a certified copy in lieu. The section works together with Section 123 (original held by the opponent or a third party) and Section 93 (when copies may stand in for originals).

Keep your key originals ready before trial, because if you cite a document and the other side objects, failing to produce the original can lead the court to refuse the copy as evidence. Supreme Court Judgment No. 6450/2552 (2009)
Where the original of a document cited by a party is in that party's own possession and the opponent objects under Section 125, the party has a duty under Section 122 to produce the original to the court on the hearing day.
The Supreme Court noted that because the original power of attorney the plaintiff relied on was in the plaintiff's possession, the plaintiff was bound under Section 122 to produce it at the hearing, and analysed the discrepancy between the power of attorney relied on and the one attached to the complaint.

When only a photocopy is filed and the original of a cited contract remains in the citing party's possession, and the opponent denies the original exists, that party must produce the original at the hearing under Sections 122 and 125; failing that, and where a copy cannot substitute under Section 93, the copy is inadmissible.
The plaintiff filed only a photocopy of a construction contract while the original stayed in its possession, and the defendants objected that no original existed. The court held the plaintiff had to produce the original under Sections 122 and 125, and since a copy could not stand in under Section 93, the copy could not be admitted.

When must I produce the original of a document I cited?
Under Section 122, if you hold the original and the other side objects under Section 125, you must produce it at the hearing at any time before judgment.
What if I cannot bring the original in time?
You may file a motion on or before the fixed day explaining why. The court can grant more time or order another arrangement, and a request only to extend time may be made ex parte.
Can I submit a copy instead of the original?
Only in limited cases. Under Section 122(2), if producing the original risks loss or serious difficulty, the court may allow a certified true copy in lieu, or submission elsewhere.
