ถ้าในข้อตกลงมิได้กำหนดข้อความไว้เป็นอย่างอื่น การตั้งอนุญาโตตุลาการให้ใช้ข้อบังคับดังต่อไปนี้
(๑) คู่ความชอบที่จะตั้งอนุญาโตตุลาการได้ฝ่ายละคน แต่ถ้าคดีมีโจทก์ร่วมหรือจำเลยร่วมหลายคน ให้ตั้งอนุญาโตตุลาการเพียงคนหนึ่งแทนโจทก์ร่วมทั้งหมดและคนหนึ่งแทนจำเลยร่วมทั้งหมด
(๒) ถ้าคู่ความจะตั้งอนุญาโตตุลาการคนเดียวหรือหลายคน ด้วยความเห็นชอบพร้อมกัน การตั้งเช่นว่านี้ให้ทำเป็นหนังสือ ลงวัน เดือน ปี และให้คู่ความลงลายมือชื่อไว้เป็นสำคัญ
(๓) ถ้าตกลงกันให้คู่ความฝ่ายหนึ่ง หรือบุคคลภายนอกเป็นผู้ตั้งอนุญาโตตุลาการ การตั้งเช่นว่านี้ ให้ทำเป็นหนังสือ ลงวัน เดือน ปี และลงลายมือชื่อของคู่ความหรือบุคคลภายนอกนั้น แล้วส่งไปให้คู่ความอื่น ๆ
(๔) ถ้าศาลไม่เห็นชอบด้วยบุคคลที่คู่ความตั้งหรือที่เสนอตั้งเป็นอนุญาโตตุลาการให้ศาลสั่งให้คู่ความตั้งบุคคลอื่นหรือเสนอบุคคลอื่นตั้งเป็นอนุญาโตตุลาการ ถ้าคู่ความมิได้ตั้งหรือเสนอให้ตั้งบุคคลใดเป็นอนุญาโตตุลาการ ให้ศาลมีอำนาจตั้งบุคคลใดเป็นอนุญาโตตุลาการได้ตามที่เห็นสมควรแล้วให้ศาลส่งคำสั่งเช่นว่านี้ไปยังอนุญาโตตุลาการที่ตั้งขึ้นและคู่ความที่เกี่ยวข้องโดยทางเจ้าพนักงานศาล

If the agreement does not provide otherwise, the appointment of arbitrators shall be governed by the following rules:
(1) each party is entitled to appoint one arbitrator, but if there are several co-plaintiffs or co-defendants, only one arbitrator shall be appointed to represent all co-plaintiffs and one to represent all co-defendants;
(2) if the parties are to appoint one or several arbitrators by common consent, such appointment shall be made in writing, dated with the day, month and year, and signed by the parties as evidence;
(3) if it is agreed that one party or a third person is to appoint the arbitrator, such appointment shall be made in writing, dated with the day, month and year, and signed by that party or third person, and then sent to the other parties;
(4) if the court does not approve of the person whom the parties have appointed or proposed to appoint as arbitrator, the court shall order the parties to appoint another person or to propose another person to be appointed as arbitrator; if the parties do not appoint or propose the appointment of any person as arbitrator, the court shall have the power to appoint any person as arbitrator as it thinks fit, and the court shall then send such order to the arbitrator so appointed and to the parties concerned through a court official.

Section 211 supplies the default mechanics for constituting the arbitral tribunal in the in-court arbitration created by Section 210, applying only where the parties' own agreement is silent. Item (1) sets the one-per-side baseline and consolidates co-parties. Items (2) and (3) impose written, dated and signed formalities for appointments made by common consent or by one party or a third person, with notice to the others. Item (4) preserves judicial oversight: the court may reject a nominee and, if the parties do not act, appoint an arbitrator of its own choice, communicated through a court official. This reinforces that in-court arbitration remains subject to the court's supervision throughout.

Supreme Court Judgment No. 2755/2516 (1973)
A proposal to appoint an arbitrator need not expressly cite the appointment rules of Civil Procedure Code Section 211 where the appointment is made under another statute that does not require it, and carrying the appointment through to completion is a duty of both sides, not one alone.
In an expropriation dispute, the objecting landowner had proposed an arbitrator. The Supreme Court held the expropriation statute did not require the proposal to specify the rules under Section 211, so the proposal was valid, and completing the appointment was the shared duty of both sides.
