Article 213: Withdrawal and challenge of arbitrator

เมื่อบุคคลหรือคู่ความที่มีสิทธิ ได้ตั้งอนุญาโตตุลาการขึ้นแล้ว ห้ามมิให้บุคคลหรือคู่ความนั้นถอนการตั้งเสีย เว้นแต่คู่ความอีกฝ่ายหนึ่งจะได้ยินยอมด้วยอนุญาโตตุลาการที่ตั้งขึ้นโดยชอบนั้น ถ้าเป็นกรณีที่ศาลหรือบุคคลภายนอกเป็นผู้ตั้ง คู่ความฝ่ายใดฝ่ายหนึ่งจะคัดค้านก็ได้ หรือถ้าเป็นกรณีที่คู่ความฝ่ายหนึ่งเป็นผู้ตั้ง คู่ความอีกฝ่ายหนึ่งจะคัดค้านก็ได้ โดยอาศัยเหตุดังที่บัญญัติไว้ในมาตรา ๑๑ หรือเหตุที่อนุญาโตตุลาการนั้นเป็นผู้ไร้ความสามารถ หรือไม่สามารถทำหน้าที่อนุญาโตตุลาการได้ ในกรณีที่มีการคัดค้านอนุญาโตตุลาการดังว่านี้ ให้นำบทบัญญัติว่าด้วยการคัดค้านผู้พิพากษามาใช้บังคับโดยอนุโลมถ้าการคัดค้านอนุญาโตตุลาการนั้นฟังขึ้น ให้ตั้งอนุญาโตตุลาการขึ้นใหม่

English translation

When a person or a party entitled to do so has appointed an arbitrator, that person or party is prohibited from withdrawing the appointment, unless the other party consents. As regards an arbitrator duly appointed: where the appointment is made by the court or by a third person, either party may object; or where the appointment is made by one party, the other party may object, on the grounds prescribed in Section 11, or on the ground that the arbitrator is incompetent or unable to perform the functions of an arbitrator. Where there is such an objection to an arbitrator, the provisions on the recusal of judges shall apply mutatis mutandis. If the objection to the arbitrator is upheld, a new arbitrator shall be appointed.

Section 213 secures the stability and impartiality of the in-court arbitral tribunal. First, it locks in an appointment: the appointing party cannot unilaterally revoke it without the opponent's consent, preventing tactical removal of an arbitrator who proves unfavourable. Second, it provides a challenge mechanism keyed to the same disqualification grounds that apply to judges under Section 11, plus incapacity or inability to serve, and it borrows the judicial recusal procedure wholesale by applying those provisions mutatis mutandis. If a challenge is upheld, the vacancy is filled by a fresh appointment, keeping the process moving. The section thus imports courtroom impartiality standards into arbitration conducted under the court's supervision.

Why this matters in practice

Two practical points stand out. First, choose your arbitrator carefully, because you cannot simply take back the appointment once made unless your opponent agrees. Second, if you have genuine concerns about an arbitrator's neutrality or capacity, the grounds mirror those for challenging a judge, so a conflict of interest or relationship that would disqualify a judge can disqualify the arbitrator too. Une partie peut-elle annuler la nomination d'un arbitre ?

Non, pas d'elle-même. En vertu de l'article 213, une fois qu'une personne ou une partie habilitée a désigné un arbitre, cette désignation ne peut être retirée sans le consentement de l'autre partie.

Pour quels motifs puis-je contester la désignation d'un arbitre ?

En vertu de l'article 213, une partie peut s'opposer à un arbitre pour les mêmes motifs que ceux qui entraînent la récusation d'un juge en vertu de l'article 11, ou parce que l'arbitre est incompétent ou incapable d'exercer ses fonctions.
