No appeal shall be allowed against a court order refusing to render judgment in accordance with the arbitrators' award, or against a court judgment rendered in accordance with the arbitrators' award, except on the following grounds:
(1) where there is an allegation showing that the arbitrators or the umpire did not act in good faith, or that either party used fraud;
(2) where the order or judgment violates a provision of law relating to the public order of the people;
(3) where the judgment does not conform to the arbitrators' award.

This section protects the finality of arbitration by shutting the door on ordinary appeals against the court's decision on an award, whether the court refused the award or enforced it. It then reopens the door only for three exceptions: (1) bad faith by the arbitrators or umpire, or fraud by a party; (2) a decision that breaches a law concerning public order; and (3) a judgment that does not match the award. The public order ground in (2) is the one most often litigated, and the courts read it together with the Arbitration Act's parallel appeal provision, so that a party can take a genuine public order objection all the way to the Supreme Court.

If you lost at the enforcement stage, do not expect a normal appeal: you must fit your challenge into one of the three grounds, and in practice the public order ground carries most challenges, for example where the court applied a repealed or wrong law. Frame the appeal around illegality that touches public order, not around dissatisfaction with the outcome. Supreme Court Judgment No. 996/2551 (2008)
A claim that enforcing an arbitration award and the judgment on it is contrary to the public order or good morals of the people falls within Section 222 and gives the objecting party the right to appeal to the Supreme Court.
The objecting party argued that the insurance association's arbitrators had no power to decide the fourteen claims submitted, and that enforcing their award through the trial court's judgment was contrary to public order and good morals. The court held that, under Section 45 of the Arbitration Act B.E. 2545 read with Section 222 of the Code, this public order allegation gave the party a right of appeal to the Supreme Court.

Supreme Court Judgment No. 995/2551 (2008)
An allegation that enforcement of an arbitration award and the judgment on it is contrary to public order or good morals is a permitted ground of appeal under Section 45 of the Arbitration Act B.E. 2545 together with Section 222 of the Code.
In a companion case, the objecting party again challenged the insurance association arbitrators' power over the claims submitted and argued that enforcing the award and judgment offended public order and good morals. The court confirmed that this ground opened a right of appeal to the Supreme Court under Section 45 of the Arbitration Act B.E. 2545 and Section 222 of the Code.

A claim that the trial court applied a repealed law is an allegation that the judgment violates a law relating to public order, which is a valid ground of appeal to the Supreme Court under Section 222 read with Section 45 of the Arbitration Act B.E. 2545.
The applicant argued that the trial court had applied a law already repealed, making its judgment on the arbitration award unlawful. The court treated this as an allegation that the judgment violated a public order law and held that, under Section 45 of the Arbitration Act B.E. 2545 and Section 222 of the Code, the applicant could appeal to the Supreme Court.

Can I appeal a court judgment enforcing an arbitration award?
Only on the three grounds in Section 222: bad faith or fraud, a violation of public order law, or a judgment that does not conform to the award. Otherwise no appeal is allowed.
What counts as a public order ground for appeal?
