Article 262 — Altering a measure when circumstances change

If the facts or circumstances on which the court relied as the basis for granting a provisional measure change, the court in which the case is pending may, when it thinks fit, or upon the application of the defendant or of a third person as provided in Section 261, make an order altering or cancelling such measure. During the period from when the court of first instance or the appellate court has read the judgment or the order disposing of the case or of the appeal, until the time when the court of first instance sends the appealed case file to the appellate court or the Supreme Court, as the case may be, an application under this Section shall be filed with the court of first instance, and it shall be within the power of the court of first instance to rule on such application.

Section 262 makes provisional measures responsive to changing facts. The court in which the case is pending may alter or cancel a measure, either on its own initiative or on application by the defendant or an affected third party under Section 261, whenever the factual basis for the original order no longer holds. The section also resolves a jurisdictional question about the transitional window between first instance and appeal: from the reading of judgment until the case file is forwarded upward, the court of first instance both receives and decides these applications. It complements Section 261, which supplies the grounds and the applicants, by fixing which court acts and when.

The trigger is a genuine change in the facts the court relied on, not a mere change of mind: keeping money on deposit while both sides appeal an unsettled debt total is not a changed circumstance. Timing the application to the correct forum avoids a rejected motion and lost time.

  3. Supreme Court Judgment No. 954/2510 (1967)

    While the case is pending before the court of first instance, the power to alter or cancel a provisional measure when the facts relied on change belongs to that court under Section 262, not to the Supreme Court, since the case is not yet regarded as pending before the Supreme Court.

    The case was still pending before the court of first instance when the defendant petitioned the Supreme Court against an interim protective order. The Supreme Court held that the power to alter or cancel the measure when the underlying facts change rests with the court of first instance under Section 262, not the Supreme Court.
