Article 324: Priority claims on execution sale proceeds

บุคคลใดมีสิทธิที่จะได้รับชำระหนี้หรือได้รับส่วนแบ่งจากเงินที่ได้จากการขายทอดตลาดหรือจำหน่ายโดยวิธีอื่นซึ่งทรัพย์สินของลูกหนี้ตามคำพิพากษาที่เจ้าพนักงานบังคับคดีได้ยึดไว้โดยอาศัยอำนาจแห่งทรัพยสิทธิ บุริมสิทธิ สิทธิยึดหน่วง หรือสิทธิอื่นซึ่งบุคคลนั้นมีอยู่เหนือทรัพย์สิน หรืออาจร้องขอให้บังคับเหนือทรัพย์สินนั้นตามกฎหมาย ให้ดำเนินการดังต่อไปนี้
(๑) ในกรณีที่เป็นผู้รับจำนองทรัพย์สินหรือเป็นผู้ทรงบุริมสิทธิเหนืออสังหาริมทรัพย์อันได้จดทะเบียนไว้ บุคคลนั้นอาจยื่นคำร้องขอต่อศาลที่ออกหมายบังคับคดีก่อนเอาทรัพย์สินนั้นออกขายหรือจำหน่าย ขอให้มีคำสั่งอย่างหนึ่งอย่างใดดังต่อไปนี้
(ก)
ในกรณีที่อาจบังคับเอาทรัพย์สินซึ่งจำนองหลุด ขอให้เอาทรัพย์สินซึ่งจำนองนั้นหลุด ถ้าศาลมีคำสั่งอนุญาต
การยึดทรัพย์ที่จำนองนั้นเป็นอันเพิกถอนไปในตัว
(ข) ในกรณีอื่น
ขอให้เจ้าพนักงานบังคับคดีนำเงินที่ได้จากการขายหรือจำหน่ายทรัพย์สินนั้นมาชำระหนี้แก่ตนก่อนเจ้าหนี้อื่น
ทั้งนี้
ตามบทบัญญัติแห่งประมวลกฎหมายแพ่งและพาณิชย์หรือกฎหมายอื่น
(๒) ในกรณีที่ปรากฏแก่เจ้าพนักงานบังคับคดีว่าทรัพย์สินซึ่งขายหรือจำหน่ายนั้นเป็นของเจ้าของรวมอันได้จดทะเบียนไว้ ให้เจ้าพนักงานบังคับคดีกันเงินส่วนของเจ้าของรวมอื่น นอกจากส่วนของลูกหนี้ตามคำพิพากษาออกจากเงินที่ได้จากการขายหรือจำหน่ายทรัพย์สินนั้นตามที่กำหนดไว้ในมาตรา ๓๔๐
(๓) ในกรณีที่เป็นผู้ทรงสิทธิยึดหน่วงซึ่งไม่มีบุริมสิทธิเหนือทรัพย์สินที่ขายหรือจำหน่าย บุคคลนั้นอาจยื่นคำร้องขอต่อศาลที่ออกหมายบังคับคดีภายในสิบห้าวันนับแต่วันขายหรือจำหน่ายทรัพย์สินนั้น ขอให้นำเงินที่ได้จากการขายหรือจำหน่ายมาชำระหนี้แก่ตนก่อนเจ้าหนี้อื่นซึ่งไม่มีบุริมสิทธิเหนือทรัพย์สินนั้น
(๔) ในกรณีอื่นนอกจากที่ระบุไว้ใน
(๑)
(๒) และ
(๓) ผู้ทรงสิทธินั้นอาจยื่นคำร้องขอต่อศาลที่ออกหมายบังคับคดีภายในสิบห้าวันนับแต่วันขายหรือจำหน่ายทรัพย์สินนั้น ขอให้ตนได้รับส่วนแบ่งในเงินที่ได้จากการขายหรือจำหน่ายหรือขอให้นำเงินดังกล่าวมาชำระหนี้แก่ตนก่อนเจ้าหนี้อื่น ทั้งนี้ ตามบทบัญญัติแห่งประมวลกฎหมายแพ่งและพาณิชย์หรือกฎหมายอื่น

English translation

Any person who is entitled to receive payment or a share from the money obtained from the auction or other disposal of the property of the judgment debtor that the execution officer has seized, by virtue of a real right, preferential right, right of retention, or other right that person has over the property, or may apply to have enforced over that property in accordance with the law, shall proceed as follows:
(1) In the case of a mortgagee of the property, or a holder of a preferential right over immovable property that has been registered, that person may file an application with the court that issued the writ of execution, before the property is put up for sale or disposal, seeking an order of one of the following kinds:
(a) In a case where the mortgaged property may be foreclosed, an application that the mortgaged property be foreclosed. If the court grants the order, the seizure of the mortgaged property is thereby revoked;
(b) In other cases, an application that the execution officer apply the money obtained from the sale or disposal of that property to satisfy that person's claim before other creditors, all in accordance with the provisions of the Civil and Commercial Code or other laws.
(2) In the case where it appears to the execution officer that the property sold or disposed of belongs to co-owners as registered, the execution officer shall set aside the share of the other co-owners, apart from the share of the judgment debtor, from the money obtained from the sale or disposal of that property, as provided in Section 340.
(3) In the case of a holder of a right of retention that has no preferential right over the property sold or disposed of, that person may file an application with the court that issued the writ of execution within fifteen days from the date of sale or disposal of that property, seeking that the money obtained from the sale or disposal be applied to satisfy that person's claim before other creditors who have no preferential right over that property.
(4) In cases other than those specified in (1), (2), and (3), the holder of the right may file an application with the court that issued the writ of execution within fifteen days from the date of sale or disposal of that property, seeking to receive a share of the money obtained from the sale or disposal, or seeking that such money be applied to satisfy that person's claim before other creditors, all in accordance with the provisions of the Civil and Commercial Code or other laws.

Section 324 is the priority-claim provision within Part 6 and is the specific counterpart to the general safeguard in Section 322. It lets a person holding a real right, preferential right, right of retention, or other enforceable right over the seized property claim payment or a share from the sale proceeds ahead of ordinary creditors, and it channels each type of right into its own procedure and deadline. A mortgagee or registered immovable preferential right holder applies before sale, either to foreclose under (1)(a), which revokes the seizure, or to be paid first under (1)(b); registered co-owners' shares are set aside under (2) and Section 340; a bare retention right holder applies within fifteen days of sale under (3); and all other rights are dealt with under (4) within fifteen days. It works with Section 327, under which a creditor granted priority here may continue the execution. The provision was renumbered by the Civil Procedure Code Amendment Act (No. 30) B.E. 2560 (2017).

Why this matters in practice

For a mortgagee, this is how you get paid out of another creditor's forced sale without running a separate foreclosure suit: apply to the writ-issuing court before the property is sold. The deadlines are strict and differ by right, before sale for mortgagees and registered preferential holders, and within fifteen days after sale for retention rights and other claims, so a missed date can drop you back to sharing pro rata or losing priority. Anyone holding security over a debtor's asset that another creditor is executing on should get advice from a debt collection lawyer the moment they learn of the seizure.

  1. Arrêt de la Cour suprême n° 181/2568 (2025)

    A mortgagee seeking payment of the mortgage debt from the proceeds of the auction of already-seized mortgaged property proceeds under Section 324(1)(b), not by an ordinary foreclosure suit, and therefore need not give prior notice of foreclosure under Civil and Commercial Code Section 728.

    The mortgaged property had already been seized and auctioned in the creditor's execution. The mortgagee applied to be paid the mortgage debt from the proceeds ahead of other creditors under Section 324(1)(b). The Supreme Court held this was a statutory priority application, not a general foreclosure, so no prior notice of foreclosure was required.

  2. Arrêt de la Cour suprême n° 853/2567 (2024)

    Section 324(1) allows a person entitled to payment as a mortgagee to apply for the sale proceeds to be applied to their claim before other creditors, and unlike Section 322 it does not require that person to be an outside person.

    Having taken over the bank's claims, the petitioner held the mortgagee's rights over the mortgaged property. The Supreme Court held these rights were protected under Section 324(1), which lets a mortgagee seek payment from the proceeds ahead of other creditors and, unlike Section 322, imposes no requirement that the applicant be a third party.
