In an investigation of a case where death has occurred through the act of an official who claims to have acted in the course of official duty, or where the death occurred while in the custody of an official who claims to have acted in the course of official duty, or where the deceased was alleged to have resisted or obstructed an official who claims to have acted in the course of official duty, the investigating officer shall notify the public prosecutor to join the investigating officer in preparing the investigation file. In preparing the investigation file under paragraph one, the investigating officer shall be responsible for it, while the public prosecutor may give advice, examine the evidence, question, or direct the questioning of the persons concerned, from the outset of preparing the investigation file at the earliest opportunity practicable, in accordance with the criteria and methods prescribed in a ministerial regulation. In a case of urgent necessity where there is reasonable cause that the public prosecutor cannot be awaited to join in preparing the investigation file, the investigating officer may proceed with the file, but must record in the file the reason why the public prosecutor could not be awaited, and it shall be deemed a lawfully prepared investigation file.

This section imposes prosecutorial oversight on the most sensitive category of death investigations: deaths caused by officials on duty, deaths in custody, and deaths of persons said to have resisted officials. The investigating officer remains responsible for the file, but the public prosecutor is entitled to advise, examine evidence and question witnesses from the earliest practicable moment, under criteria set by ministerial regulation. It complements the special judicial inquest inquiry under Section 150 for these same categories of death and reflects reforms intended to guard against cover-ups where the State itself is implicated.
