ผู้ใดกระทำการใด ๆ เพื่อให้เกิดเหตุร้ายแก่ประเทศจากภายนอก ต้องระวางโทษจำคุกไม่เกินสิบปี ถ้าเหตุร้ายเกิดขึ้น ผู้กระทำต้องระวางโทษประหารชีวิต หรือจำคุกตลอดชีวิต หรือจำคุกตั้งแต่สองปีถึงยี่สิบปี
English translation
Whoever does any act in order to cause trouble to the country from outside shall be liable to imprisonment not exceeding ten years.
If the trouble occurs, the offender shall be liable to the death penalty, to imprisonment for life, or to imprisonment from two years to twenty years.

The offence is committed by acting in order to bring trouble on Thailand from outside, and it is complete whether or not the trouble follows. Where the trouble does occur, the section escalates sharply, to death, imprisonment for life, or two to twenty years. That structure, a preparatory offence with a result-based uplift, is common in this Chapter.
