Article 205: Negligently allowing a detainee to escape

ถ้าการกระทำดังกล่าวในมาตรา ๒๐๔ เป็นการกระทำโดยประมาท ผู้กระทำต้องระวางโทษจำคุกไม่เกินสองปี หรือปรับไม่เกินสี่หมื่นบาท หรือทั้งจำทั้งปรับ ถ้าผู้ที่หลุดพ้นจากการคุมขังไปด้วยการกระทำโดยประมาทนั้น เป็นบุคคลที่ต้องคำพิพากษาของศาลหนึ่งศาลใดให้ลงโทษประหารชีวิต จำคุกตลอดชีวิต หรือจำคุกตั้งแต่สิบห้าปีขึ้นไป หรือมีจำนวนตั้งแต่สามคนขึ้นไป ผู้กระทำต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินหกหมื่นบาท หรือทั้งจำทั้งปรับ ถ้าผู้กระทำความผิด จัดให้ได้ตัวผู้ที่หลุดพ้นจากการคุมขังคืนมาภายในสามเดือน ให้งดการลงโทษแก่ผู้กระทำความผิดนั้น หมายเหตุ: [อัตราโทษ แก้ไขเพิ่มเติมโดยมาตรา ๔ แห่งพระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายอาญา (ฉบับที่ ๒๖) พ.ศ. ๒๕๖๐]
English translation
If an act referred to in Section 204 is done negligently, the offender shall be liable to imprisonment not exceeding two years, or a fine not exceeding forty thousand baht, or both.
If the person who escapes from custody through that negligent act is a person sentenced by any court to death, to imprisonment for life, or to imprisonment of fifteen years or more, or if the persons who escape number three or more, the offender shall be liable to imprisonment not exceeding three years, or a fine not exceeding sixty thousand baht, or both.
If the offender procures the return of the person who escaped from custody within three months, the punishment of that offender shall be remitted.

This is the negligent version of Section 204, which covers an official allowing a person in custody to escape. Negligence carries up to two years, or a fine of up to 40,000 baht, or both, against the intentional offence's heavier range. The section then adds a result-based uplift keyed to the escapee's sentence, so allowing a person sentenced to death or life to escape through negligence is punished more severely than allowing a short-term prisoner to.
