ถ้ามีการแบ่งแยกสามยทรัพย์ ท่านว่าภาระจำยอมยังคงมีอยู่เพื่อประโยชน์แก่ทุกส่วนที่แยกออกนั้น แต่ถ้าภาระจำยอมนั้นไม่ใช้และใช้ไม่ได้ตามรูปการเพื่อประโยชน์แก่ส่วนใดไซร้ ท่านว่าเจ้าของภารยทรัพย์จะเรียกให้พ้นจากภาระจำยอมอันเกี่ยวกับทรัพย์ส่วนนั้นก็ได้

English translation
Where the dominant property is divided, the servitude continues for the benefit of every part into which it is divided.
But where the servitude does not benefit, and by its nature cannot benefit, a particular part, the owner of the servient property may demand that that part be released from the servitude.
