ถ้าไม่มีผู้ที่มีอำนาจให้ความยินยอมตามมาตรา ๑๔๕๔ หรือมีแต่ไม่ให้ความยินยอมหรือไม่อยู่ในสภาพที่อาจให้ความยินยอม หรือโดยพฤติการณ์ผู้เยาว์ไม่อาจขอความยินยอมได้ ผู้เยาว์อาจร้องขอต่อศาลเพื่ออนุญาตให้ทำการสมรส
