Article 1537: Child born after a remarriage in breach of Section 1453

ในกรณีที่หญิงทำการสมรสใหม่นั้นเป็นการฝ่าฝืนมาตรา ๑๔๕๓ และคลอดบุตรภายในสามร้อยสิบวันนับแต่วันที่การสมรสสิ้นสุดลง ให้สันนิษฐานไว้ก่อนว่า เด็กที่เกิดแต่หญิงนั้นเป็นบุตรชอบด้วยกฎหมายของชายผู้เป็นคู่สมรสคนใหม่ และห้ามมิให้นำข้อสันนิษฐานในมาตรา ๑๕๓๖ ที่ว่า เด็กเป็นบุตรชอบด้วยกฎหมายของชายผู้เป็นคู่สมรสเดิม มาใช้บังคับ ทั้งนี้ เว้นแต่มีคำพิพากษาของศาลแสดงว่า เด็กมิใช่บุตรชอบด้วยกฎหมายของชายผู้เป็นคู่สมรสคนใหม่นั้น

Where a woman's new marriage contravenes Section 1453 and she gives birth to a child within three hundred and ten days from the day the marriage came to an end, the child born of that woman is presumed to be the legitimate child of the man who is her new spouse, and the presumption under Section 1536 that the child is the legitimate child of the man who was her former spouse does not apply, unless there is a judgment of the court showing that the child is not the legitimate child of that new spouse.
