เด็กเกิดแต่หญิงขณะเป็นคู่สมรสกับชาย หรือภายในสามร้อยสิบวันนับแต่วันที่การสมรสสิ้นสุดลง ให้สันนิษฐานไว้ก่อนว่าเป็นบุตรชอบด้วยกฎหมายของชายผู้เป็นคู่สมรส หรือเคยเป็นคู่สมรส แล้วแต่กรณี

A child born of a woman while she is the spouse of a man, or within three hundred and ten days from the day the marriage came to an end, is presumed to be the legitimate child of the man who is, or was, her spouse, as the case may be.

Paragraph one applies to a child born of a woman before the judgment of the court declaring the marriage void became final, or within three hundred and ten days from that day.

Section 1536 creates a strong legal presumption, the husband is the father unless he successfully challenges it under §1539 (denial of paternity action) within one year of knowing the basis. The presumption matters because (a) only legitimate children inherit automatically as Class 1 heirs (§1629); (b) the father has automatic parental power (§1556); (c) the mother cannot unilaterally change the child's name or take the child abroad without consent.
