ในกรณีที่สันนิษฐานว่า เด็กเป็นบุตรชอบด้วยกฎหมายของชายผู้เป็นหรือเคยเป็นคู่สมรสตามมาตรา ๑๕๓๖ มาตรา ๑๕๓๗ หรือมาตรา ๑๕๓๘ ชายผู้เป็นหรือเคยเป็นคู่สมรสจะไม่รับเด็กเป็นบุตรของตนก็ได้ โดยฟ้องเด็กกับมารดาร่วมกันเป็นจำเลยและพิสูจน์ได้ว่า ตนไม่ได้อยู่ร่วมกับมารดาเด็กในระยะเวลาตั้งครรภ์ คือ ระหว่างหนึ่งร้อยแปดสิบวันถึงสามร้อยสิบวันก่อนเด็กเกิด หรือตนไม่สามารถเป็นบิดาของเด็กได้เพราะเหตุอย่างอื่น
แต่ถ้าในขณะยื่นฟ้องมารดาเด็กไม่มีชีวิตอยู่ จะฟ้องเด็กแต่ผู้เดียวเป็นจำเลยก็ได้ ถ้าเด็กไม่มีชีวิตอยู่ไม่ว่ามารดาของเด็กจะมีชีวิตอยู่หรือไม่ จะยื่นคำร้องขอให้ศาลแสดงว่าเด็กนั้นไม่เป็นบุตรก็ได้ ในกรณีที่มารดาของเด็กหรือทายาทของเด็กยังมีชีวิตอยู่ ให้ศาลส่งสำเนาคำร้องนี้ไปให้ด้วย และถ้าศาลเห็นสมควร จะส่งสำเนาคำร้องไปให้อัยการพิจารณาเพื่อดำเนินคดีแทนเด็กด้วยก็ได้

Where a child is presumed to be the legitimate child of the man who is or was a spouse under Section 1536, Section 1537 or Section 1538, that man may repudiate the child by bringing an action against the child and the mother jointly as defendants, and proving that he did not cohabit with the mother of the child during the period of conception, that is between one hundred and eighty and three hundred and ten days before the birth of the child, or that he could not be the father of the child for some other reason.
But if the mother of the child is no longer living at the time the action is brought, the action may be brought against the child alone. If the child is no longer living, whether or not the mother is living, an application may be made for the court to declare that the child is not his child. Where the mother of the child, or an heir of the child, is living, the court shall send them a copy of that application, and if the court thinks fit it may send a copy to the public prosecutor to consider conducting the case on behalf of the child.
