ในกรณีที่ผู้เยาว์ถูกศาลสั่งให้เป็นคนไร้ความสามารถและศาลมีคำสั่งตั้งบุคคลอื่นซึ่งมิใช่ผู้ใช้อำนาจปกครองหรือผู้ปกครองเป็นผู้อนุบาลให้คำสั่งนั้นมีผลเป็นการถอนผู้ใช้อำนาจปกครอง หรือผู้ปกครองที่เป็นอยู่ในขณะนั้น ในกรณีที่บุคคลซึ่งบรรลุนิติภาวะและไม่มีคู่สมรสถูกศาลสั่งให้เป็นคนไร้ความสามารถหรือเสมือนไร้ความสามารถ ให้บิดามารดา หรือบิดาหรือมารดาเป็นผู้อนุบาลหรือผู้พิทักษ์ แล้วแต่กรณี เว้นแต่ศาลจะสั่งเป็นอย่างอื่น

Dans le cas où un mineur est déclaré incapable ou quasi incapable et qu'une autre personne, autre que celle exerçant l'autorité parentale ou le tuteur, est désignée comme tuteur par décision de justice, cette décision entraîne la révocation de l'autorité parentale ou de la tutelle en vigueur. Dans le cas où une personne majeure et célibataire est déclarée incapable ou quasi incapable, les parents, le père ou la mère sont désignés comme tuteur ou curateur, selon le cas, sauf décision contraire du tribunal.
