บุคคลใดจะโอนทรัพย์สินให้ผู้เยาว์โดยพินัยกรรมหรือโดยการให้โดยเสน่หาซึ่งมีเงื่อนไขให้บุคคลอื่นนอกจากผู้ใช้อำนาจปกครองเป็นผู้จัดการจนกว่าผู้เยาว์จะบรรลุนิติภาวะก็ได้ ผู้จัดการนั้นต้องเป็นผู้ซึ่งผู้โอนระบุชื่อไว้ หรือถ้ามิได้ระบุไว้ก็ให้ศาลสั่ง แต่การจัดการทรัพย์สินนั้นต้องอยู่ภายใต้บังคับมาตรา ๕๖ มาตรา ๕๗ มาตรา ๖๐ หมายเหตุ: [เลขมาตรา ๕๖ มาตรา ๕๗ มาตรา ๖๐ แก้ไขเพิ่มเติมโดยมาตรา ๑๕ แห่งพระราชบัญญัติให้ใช้บทบัญญัติบรรพ ๑ แห่งประมวลกฎหมายแพ่งและพาณิชย์ที่ได้ตรวจชำระใหม่ พ.ศ. ๒๕๓๕]

Une personne peut transmettre un bien par legs ou donation à un mineur, sous réserve que sa gestion, jusqu'à sa majorité, soit confiée à une personne autre que celle exerçant l'autorité parentale. Ce tuteur doit être désigné par le donateur, à défaut, ou par décision de justice, et sa gestion est soumise aux dispositions des articles 56, 57 et 60.
