เมื่อบุคคลใดต้องถือว่าถึงแก่ความตายตามความในมาตรา ๖๒ แห่งประมวลกฎหมายนี้ มรดกของบุคคลนั้นตกทอดแก่ทายาท ถ้าพิสูจน์ได้ว่าบุคคลนั้นยังคงมีชีวิตอยู่ หรือตายในเวลาอื่นผิดไปจากเวลาดังระบุไว้ในคำสั่งที่สั่งให้เป็นคนสาบสูญ ให้ใช้บทบัญญัติมาตรา ๖๓ แห่งประมวลกฎหมายนี้บังคับแก่ทายาทของบุคคลนั้น หมายเหตุ: [เลขมาตรา ๖๒ มาตรา ๖๓ แก้ไขเพิ่มเติมโดยมาตรา ๑๕ แห่งพระราชบัญญัติให้ใช้บทบัญญัติบรรพ ๑ แห่งประมวลกฎหมายแพ่งและพาณิชย์ที่ได้ตรวจชำระใหม่ พ.ศ. ๒๕๓๕]

English translation
Where a person is deemed to have died under Section 62 of this Code, his estate devolves on his heirs.
If it is proved that the person is still alive, or died at a time other than that stated in the order declaring him a disappeared person, Section 63 of this Code applies to his heirs.
