พินัยกรรมจะทำขึ้นโดยให้บุคคลใดตกอยู่ในภาระติดพันที่จะต้องก่อตั้งมูลนิธิ หรือจะสั่งจัดสรรทรัพย์สินไว้โดยตรง เพื่อประโยชน์อย่างใดอย่างหนึ่งตามบทบัญญัติมาตรา ๑๑๐ แห่งประมวลกฎหมายนี้ก็ได้ หมายเหตุ: [เลขมาตรา ๑๑๐ แก้ไขเพิ่มเติมโดยมาตรา ๑๕ แห่งพระราชบัญญัติให้ใช้บทบัญญัติบรรพ ๑ แห่งประมวลกฎหมายแพ่งและพาณิชย์ที่ได้ตรวจชำระใหม่ พ.ศ. ๒๕๓๕]
