การที่ทายาทคนใดได้รับทรัพย์สินอย่างหนึ่งอย่างใด หรือประโยชน์อย่างอื่นใดจากเจ้ามรดกโดยการให้ หรือโดยการอย่างอื่นใด ซึ่งทำให้โดยเสน่หาในระหว่างเวลาที่เจ้ามรดกยังมีชีวิตอยู่นั้น หาทำให้สิทธิในการแบ่งปันทรัพย์มรดกของทายาทคนนั้น ต้องเสื่อมเสียไปแต่โดยประการใดไม่

English translation
The fact that an heir has received any property or other benefit from the deceased by gift, or by any other gratuitous means, during the lifetime of the deceased does not in any way impair that heir's right in the division of the estate.
