อันการชำระหนี้นั้น ท่านว่าบุคคลภายนอกจะเป็นผู้ชำระก็ได้ เว้นแต่สภาพแห่งหนี้จะไม่เปิดช่องให้บุคคลภายนอกชำระ หรือจะขัดกับเจตนาอันคู่กรณีได้แสดงไว้บุคคลผู้ไม่มีส่วนได้เสียด้วยในการชำระหนี้นั้น จะเข้าชำระหนี้โดยขืนใจลูกหนี้หาได้ไม่

English translation
Performance of an obligation may be made by any third person, unless its nature does not admit of it, or the parties concerned have declared a contrary intention. A person who has no interest in the performance, cannot make performance against the will of the debtor.
