บุคคลดังจะกล่าวต่อไปนี้ไม่มีสิทธิจะได้รับคืนทรัพย์ คือ(๑) บุคคลผู้ชำระหนี้อันมีเงื่อนเวลาบังคับเมื่อก่อนถึงกำหนดเวลานั้น(๒) บุคคลผู้ชำระหนี้ซึ่งขาดอายุความแล้ว(๓) บุคคลผู้ชำระหนี้ตามหน้าที่ศีลธรรม หรือตามควรแก่อัธยาศัยในสมาคม

The following persons are not entitled to restitution: A person who performs an obligation subject to a time clause before the time has arrived A person who performs an obligation which has been barred by prescription A person who performs an obligation in compliance with a moral duty or with the requirements of social propriety.
