บุคคลใดได้กระทำการอันใดตามอำเภอใจเหมือนหนึ่งว่าเพื่อชำระหนี้โดยรู้อยู่ว่าตนไม่มีความผูกพันที่จะต้องชำระ ท่านว่าบุคคลผู้นั้นหามีสิทธิจะได้รับคืนทรัพย์ไม่
