Si une personne tenue d'indemniser une personne pour un dommage causé par la prise ou la détérioration d'un bien meuble indemnise la personne qui détenait le bien au moment de la prise ou de la détérioration, elle est libérée de cette obligation même si un tiers était propriétaire du bien ou avait un autre droit sur celui-ci, à moins que le droit du tiers ne lui soit connu ou ne demeure inconnu en raison d'une négligence grave.
