ถ้าระยะเวลาที่ได้ตกลงว่าจ้างกันนั้นสุดสิ้นลงแล้ว ลูกจ้างยังคงทำงานอยู่ต่อไปอีก และนายจ้างรู้ดังนั้นก็ไม่ทักท้วงไซร้ ท่านให้สันนิษฐานไว้ก่อนว่าคู่สัญญาเป็นอันได้ทำสัญญาจ้างกันใหม่โดยความอย่างเดียวกันกับสัญญาเดิม แต่คู่สัญญาฝ่ายใดฝ่ายหนึ่งอาจจะเลิกสัญญาเสียได้ด้วยการบอกกล่าวตามความในมาตราต่อไปนี้

English translation
If after the end of the agreed period the employee continues to render services and the employer knowing thereof does not object, the parties are presumed to have made a new contract of hire on the same terms, but either party can terminate the contract by giving notice in accordance with the following section.
