ถ้าได้กำหนดเวลากันไว้ว่าจะพึงคืนทรัพย์สินซึ่งฝากนั้นเมื่อไร ท่านว่าผู้รับฝากไม่มีสิทธิจะคืนทรัพย์สินก่อนถึงเวลากำหนด เว้นแต่ในเหตุจำเป็นอันมิอาจจะก้าวล่วงเสียได้
