Lorsqu'un bien a été hypothéqué et qu'une servitude ou un autre droit réel est enregistré après l'inscription de l'hypothèque sans le consentement du créancier hypothécaire, l'hypothèque prime la servitude ou l'autre droit réel et ce dernier sera radié du registre si son existence porte atteinte au droit du créancier hypothécaire de faire exécuter l'hypothèque.
