เมื่อบุคคลหลายคนต่างได้จำนองทรัพย์สินแห่งตนเพื่อประกันหนี้แต่รายหนึ่งรายเดียวอันบุคคลอื่นจะต้องชำระและได้ระบุลำดับไว้ด้วยไซร้ ท่านว่าการที่ผู้รับจำนองยอมปลดหนี้ให้แก่ผู้จำนองคนหนึ่งนั้น ย่อมทำให้ผู้จำนองคนหลัง ๆ ได้หลุดพ้นด้วยเพียงขนาดที่เขาต้องรับความเสียหายแต่การนั้น

Lorsque plusieurs personnes ont hypothéqué séparément leurs biens en garantie de l'exécution d'une même obligation par une autre personne et qu'une ordonnance a été spécifiée, la mainlevée accordée par le créancier hypothécaire à l'un des débiteurs hypothécaires libère les débiteurs hypothécaires subséquents à concurrence du préjudice qu'ils ont subi de ce fait.
