การใช้เงินอาศัยเหตุความทรงชีพ หรือมรณะของบุคคลผู้ใด แม้ได้แถลงอายุของบุคคลผู้นั้นไว้คลาดเคลื่อนไม่ถูกต้องเป็นเหตุให้ได้กำหนดจำนวนเบี้ยประกันภัยไว้ต่ำไซร้ ท่านให้ลดจำนวนเงินอันผู้รับประกันภัยจะพึงต้องใช้นั้นลงตามส่วนแต่ถ้าผู้รับประกันภัยพิสูจน์ได้ว่าในขณะที่ทำสัญญานั้น อายุที่ถูกต้องแท้จริงอยู่นอกจำกัดอัตราตามทางค้าปกติของเขาแล้ว ท่านว่าสัญญานั้นเป็นโมฆียะ

English translation
Where payment depends on the life or death of a person and that person's age has been incorrectly stated, so that the premium was fixed too low, the sum payable by the insurer is reduced proportionately.
But where the insurer proves that at the time of the contract the true age was outside the limits of his ordinary business, the contract is voidable.
