Article 129: Court appointment of experts

ในการที่ศาลจะมีคำสั่งให้แต่งตั้งผู้เชี่ยวชาญดังกล่าวมาในมาตรา ๙๙ โดยที่ศาลเห็นสมควรหรือโดยที่คู่ความฝ่ายใดฝ่ายหนึ่งร้องขอนั้น
(๑) การแต่งตั้งผู้เชี่ยวชาญเช่นว่านั้นให้อยู่ในดุลพินิจของศาล แต่ศาลจะเรียกคู่ความมาให้ตกลงกันกำหนดตัวผู้เชี่ยวชาญที่จะแต่งตั้งนั้นก็ได้ แต่ศาลจะบังคับบุคคลใดให้เป็นผู้เชี่ยวชาญไม่ได้ นอกจากบุคคลนั้นได้ยินยอมลงชื่อเป็นผู้เชี่ยวชาญไว้ในทะเบียนผู้เชี่ยวชาญของศาลแล้ว
(๒) ผู้เชี่ยวชาญที่ศาลแต่งตั้งอาจถูกคัดค้านได้และต้องสาบานหรือปฏิญาณตน ทั้งมีสิทธิที่จะได้รับค่าธรรมเนียมและรับชดใช้ค่าใช้จ่ายที่ได้ออกไปตามที่กำหนดไว้ในกฎกระทรวงว่าด้วยการนั้น

English translation

As regards the court's order appointing an expert referred to in Section 99, whether the court thinks fit or a party requests, then:
(1) the appointment of such an expert is within the court's discretion, but the court may summon the parties to agree on who is to be appointed as the expert; the court may not, however, compel any person to be an expert unless that person has consented by signing as an expert in the court's register of experts;
(2) an expert appointed by the court may be challenged and must take an oath or affirmation, and is entitled to receive fees and to be reimbursed for expenses incurred, as prescribed in the ministerial regulation on that matter.

Section 129 governs how the court appoints an expert of the kind mentioned in Section 99. Appointment is discretionary and may be initiated by the court or a party; the court may invite the parties to agree on the expert but cannot compel anyone to act unless they have consented by registering in the court's expert register. Subsection (2) safeguards fairness and reliability: the appointed expert may be challenged, must swear an oath, and is entitled to fees and reimbursement under the relevant ministerial regulation, which the court may allocate between the parties as a court fee. The section works with Section 99 (calling for experts) and Section 130 (how the expert's opinion is given and used).

Why this matters in practice

If a signature, handwriting, or technical point is contested, consider asking the court under Section 129 to appoint an expert, or propose one the parties can agree on. Expect to advance the expert's fees, which the court treats as a court fee and may finally allocate to the losing side. If the proposed expert is biased or unqualified, you can challenge the appointment, so vet the candidate carefully. Expert-led cases reward early planning, so take advice on framing the questions the expert should answer.

    An expert is validly appointed under Sections 99 and 129 once the court issues an order designating the expert to carry out the examination, even where the order refers generally to a forensic office and the court then directs a specific officer.

    The court had ordered a forensic examination and then sent the documents to a named police officer to examine. The Supreme Court held this amounted to a valid appointment of an expert under Sections 99 and 129, as the court had issued an order designating the person to perform the examination.

  2. Arrêt de la Cour suprême n° 2372/2539 (1996)

    An expert's fee for examining a document under Section 129(2) is a fee the law requires to be paid, and the court may in its discretion order either party to bear it, even though it is not listed in the fee schedules annexed to the Code.

    Where the second defendant had to prove by an expert that a signature on a guarantee was forged and paid the examination cost, the court held it had discretion to order a party to bear that cost as an expert's fee under Section 129(2), being a fee the law requires even though not listed in the annexed schedules.
