If the offender is known and that person is under custody or detention, or has been provisionally released, or is believed likely to be secured upon the issuance of a summons, the inquiry official shall prepare an opinion, according to the investigation file, whether prosecution should be ordered or not, and send it to the public prosecutor together with the file. Where the opinion proposes non-prosecution, only the file together with the opinion shall be sent to the public prosecutor; as for the accused, the inquiry official has the power to release or provisionally release him. If the accused is detained, the official shall himself apply, or request the public prosecutor to apply, to the court for release. Where the opinion proposes prosecution, the inquiry official shall send the file together with the accused to the public prosecutor, except where the accused is already detained, or where the accused who has been charged has fled. But if it is an offence which the inquiry official may settle by compounding and the offender has complied with that settlement, the record of the compounding shall be made and sent to the public prosecutor together with the file.

It ties the movement of the physical accused to the direction of the inquiry official's opinion: non-prosecution means release and file-only transmission, while prosecution means the accused travels with the file to the prosecutor. It also carries the inquiry official's power over custody and provisional release at this stage, and preserves the compounding route for eligible offences before the file leaves police hands.

For an accused on provisional release, this section decides whether you are physically handed to the prosecutor or freed, depending on the inquiry official's recommendation. Failure by the officer to actually transmit the file and opinion to the prosecutor is a real risk that can delay or derail a case, and has itself grounded criminal liability against officers. If your matter is a compoundable offence, resolving it at this stage can end the case before it reaches court.

An inquiry official's failure to send the file and opinion to the public prosecutor as required by section 142 is a breach of the prescribed procedure.
The officer did not send the file together with his opinion to the provincial public prosecutor as required by section 142, and after being transferred took the investigation file with him although it belonged in the police station's official system. The court found the claim of merely forgetting to forward it hard to accept.

Is a suspect sent to the prosecutor with the police file?
Under section 142, if the inquiry official recommends prosecution the accused is sent with the file to the prosecutor, unless already detained or the charged accused has fled. If non-prosecution is recommended, only the file is sent and the accused is released.
What happens to a compoundable offence at this stage?
If the offence can be settled by compounding and the offender has complied, section 142 requires the inquiry official to record the compounding and forward it to the prosecutor with the file.
