Whoever kills the Queen or the Heir-apparent, or kills the Regent, shall be liable to the death penalty.
Whoever attempts to commit such an act shall be liable to the same punishment.
Whoever does any act in preparation for killing the Queen or the Heir-apparent, or for killing the Regent, or who, knowing that a person is going to kill the Queen or the Heir-apparent, or to kill the Regent, does any act to help conceal it, shall be liable to imprisonment from twelve years to twenty years.

L'article 109 constitue une disposition spéciale relative à la tentative, qui remplace la règle générale énoncée aux articles 80 à 82, selon laquelle une tentative est normalement punie des deux tiers de la peine encourue pour l'infraction consommée. Pour les infractions les plus graves contre le Roi, la Reine et l'Héritier présomptif, visées aux articles 107 et 108, la tentative est traitée exactement comme l'infraction consommée ; ainsi, la peine maximale, allant de la peine de mort à la réclusion à perpétuité, s'applique même si l'acte n'a pas été commis. Ceci témoigne de la gravité exceptionnelle que le Code accorde aux attaques contre ces personnes et fait écho aux règles similaires de peine maximale pour tentative prévues ailleurs dans le Code de la sécurité du Royaume.
Pourquoi cela est important en pratique
Concrètement, aucune réduction de peine n'est accordée pour une agression incomplète : une tentative, au sens des articles 107 ou 108, est passible de la même peine de mort ou de la réclusion à perpétuité qu'une agression consommée. La défense ne peut donc pas invoquer la réduction de peine habituelle pour tentative et s'attachera plutôt à déterminer si les agissements ont franchi le stade de la simple préparation pour constituer une tentative punissable, ainsi qu'à identifier la personne prétendument visée. La sévérité des peines encourues rend indispensable le recours rapide à un avocat pénaliste spécialisé.
