L'article 120, figurant dans le chapitre relatif à la sécurité extérieure, ne concerne que les ressortissants thaïlandais, faisant ainsi de la nationalité un élément constitutif de l'infraction. Il vise trois types de comportements : faire la guerre à la Thaïlande, préparer une telle guerre et se rendre complice de l'ennemi contre le Royaume. En incriminant expressément la préparation, il établit la responsabilité bien avant le début des hostilités.
