Key points
- A superficies lets you own buildings, structures or plantations on land owned by someone else (Section 1410 of the Civil and Commercial Code).
- It can be for a fixed term of up to 30 years, renewable, or for the life of the landowner or of the superficiary (Section 1412).
- Unless the agreement says otherwise, it can be transferred and inherited (Section 1411).
- It must be registered at the Land Office.
- Foreigners often combine it with a lease or a usufruct to protect a house built on Thai land.
