Si une personne a, de mauvaise foi, construit un bâtiment sur le terrain d'autrui, elle doit restituer le terrain après l'avoir remis dans son état initial, à moins que le propriétaire du terrain ne choisisse de le récupérer dans son état actuel, auquel cas il doit payer, à son choix, le prix du bâtiment ou une somme représentant la plus-value du terrain.
