บุคคลใดสร้างโรงเรือนในที่ดินของผู้อื่นโดยสุจริตไซร้ ท่านว่าเจ้าของที่ดินเป็นเจ้าของโรงเรือนนั้น ๆ แต่ต้องใช้ค่าแห่งที่ดินเพียงที่เพิ่มขึ้นเพราะสร้างโรงเรือนนั้นให้แก่ผู้สร้างแต่ถ้าเจ้าของที่ดินสามารถแสดงได้ว่า มิได้มีความประมาทเลินเล่อ จะบอกปัดไม่ยอมรับโรงเรือนนั้นและเรียกให้ผู้สร้างรื้อถอนไป และทำที่ดินให้เป็นตามเดิมก็ได้ เว้นไว้แต่ถ้าการนี้จะทำไม่ได้โดยใช้เงินพอสมควรไซร้ ท่านว่าเจ้าของที่ดินจะเรียกให้ผู้สร้างซื้อที่ดินทั้งหมดหรือแต่บางส่วนตามราคาตลาดก็ได้

English translation
Where a person builds a structure on another person's land in good faith, the owner of the land becomes the owner of the structure, but must pay the builder the amount by which the value of the land has increased by reason of the structure. However, if the owner of the land can show that he was not negligent, he may refuse to accept the structure and require the builder to remove it and to restore the land to its former condition. Where this cannot be done at reasonable expense, the owner of the land may require the builder to buy the land, in whole or in part, at the market price.
