Si une personne a construit de bonne foi un bâtiment empiétant sur le terrain d'autrui, elle en devient propriétaire, sous réserve du paiement au propriétaire du terrain d'une redevance pour l'utilisation dudit terrain et de l'inscription de ses droits sur la partie empiétée sous forme de servitude. Le propriétaire du terrain peut exiger la radiation de cette inscription si le bâtiment est ultérieurement entièrement détruit. Si le constructeur est de mauvaise foi, le propriétaire du terrain peut exiger la démolition du bâtiment et la remise en état du terrain, aux frais du constructeur.
