La servitude s'éteint lorsqu'elle cesse de procurer un avantage au fonds dominant ; elle renaît si les conditions permettent à nouveau d'en jouir, pourvu que le délai de prescription prévu à l'article précédent ne soit pas expiré. Lorsque la servitude procure encore un certain avantage au fonds dominant, mais que cet avantage est négligeable par rapport à la charge qu'il impose au fonds servant, le propriétaire de ce dernier peut, moyennant le versement d'une indemnité, obtenir la levée totale ou partielle de la servitude.
