การหมั้นไม่เป็นเหตุที่จะร้องขอให้ศาลบังคับให้สมรสได้ ถ้าได้มีข้อตกลงกันไว้ว่าจะให้เบี้ยปรับในเมื่อผิดสัญญาหมั้น ข้อตกลงนั้นเป็นโมฆะ

English translation
An engagement is not a ground on which the court may be asked to compel a marriage.
Any agreement to pay a penalty in the event of a breach of the engagement is void.
