เมื่อมีพฤติการณ์พิเศษซึ่งไม่อาจทำการจดทะเบียนสมรสต่อนายทะเบียนได้เพราะบุคคลฝ่ายใดฝ่ายหนึ่งหรือทั้งสองฝ่ายตกอยู่ในอันตรายใกล้ความตาย หรืออยู่ในภาวะการรบหรือสงคราม ถ้าบุคคลทั้งสองนั้นได้แสดงเจตนาจะสมรสกันต่อหน้าบุคคลซึ่งบรรลุนิติภาวะที่อยู่ ณ ที่นั้น แล้วให้บุคคลดังกล่าวจดแจ้งการแสดงเจตนาขอทำการสมรสของบุคคลทั้งสองนั้นไว้เป็นหลักฐาน และต่อมาบุคคลทั้งสองได้จดทะเบียนสมรสกันภายในเก้าสิบวันนับแต่วันที่อาจทำการจดทะเบียนต่อนายทะเบียนได้ โดยแสดงหลักฐานต่อนายทะเบียนและให้นายทะเบียนจดแจ้งวัน เดือน ปี สถานที่ที่แสดงเจตนาขอทำการสมรส และพฤติการณ์พิเศษนั้นไว้ในทะเบียนสมรส ให้ถือว่าวันแสดงเจตนาขอทำการสมรสต่อบุคคลดังกล่าวเป็นวันจดทะเบียนสมรสต่อนายทะเบียนแล้ว
ความในมาตรานี้มิให้ใช้บังคับถ้าหากจะมีการสมรสในวันแสดงเจตนาขอทำการสมรส การสมรสนั้นจะตกเป็นโมฆะ

Where special circumstances make it impossible to register a marriage before the registrar because either or both of the persons is in imminent danger of death, or is in a situation of combat or war, and those two persons have declared their intention to marry before a person of full age who is present there, and that person has recorded their declaration of intention to marry as evidence, and the two persons afterwards register the marriage within ninety days from the day on which registration before the registrar became possible, producing that evidence to the registrar, who shall record in the marriage register the day, month, year and place of the declaration and the special circumstances, then the day on which the intention to marry was declared before that person is deemed to be the day on which the marriage was registered before the registrar.
The provisions of this Section do not apply where, had the marriage been made on the day the intention to marry was declared, that marriage would have been void.
