เมื่อปรากฏข้อเท็จจริงต่อเด็กว่าตนมิได้เป็นบุตรสืบสายโลหิตของชายผู้เป็นคู่สมรสของมารดาตน เด็กจะร้องขอต่ออัยการให้ฟ้องคดีปฏิเสธความเป็นบุตรชอบด้วยกฎหมายของชายนั้นก็ได้
การฟ้องคดีตามวรรคหนึ่ง ถ้าเด็กได้รู้ข้อเท็จจริงก่อนบรรลุนิติภาวะว่าตนมิได้เป็นบุตรของชายผู้เป็นคู่สมรสของมารดา ห้ามอัยการฟ้องคดีเมื่อพ้นหนึ่งปีนับแต่วันที่เด็กบรรลุนิติภาวะ แต่ถ้าเด็กรู้ข้อเท็จจริงดังกล่าวหลังจากบรรลุนิติภาวะแล้ว ห้ามอัยการฟ้องคดีเมื่อพ้นหนึ่งปีนับแต่วันที่เด็กรู้เหตุนั้น
ไม่ว่ากรณีใด ๆ ห้ามมิให้ฟ้องคดีปฏิเสธความเป็นบุตรเมื่อพ้นสิบปีนับแต่วันที่เด็กบรรลุนิติภาวะ

English translation
Where it appears to a child that the child is not the blood descendant of the man who is the spouse of the child's mother, the child may apply to the public prosecutor to bring an action denying that the child is the legitimate child of that man.
As to an action under paragraph one, if the child knew the facts before attaining majority, the public prosecutor may not bring the action after one year from the day the child attained majority; but if the child learned those facts after attaining majority, the public prosecutor may not bring the action after one year from the day the child learned them.
In no case may an action denying legitimacy be brought after ten years from the day the child attained majority.
