ถ้าในกิจการใด ประโยชน์ของผู้ใช้อำนาจปกครอง หรือประโยชน์ของคู่สมรสหรือบุตรของผู้ใช้อำนาจปกครองขัดกับประโยชน์ของผู้เยาว์ ผู้ใช้อำนาจปกครองต้องได้รับอนุญาตจากศาลก่อนจึงทำกิจการนั้นได้ มิฉะนั้นเป็นโมฆะ
