Article 1574: Parental control of child's property

นิติกรรมใดอันเกี่ยวกับทรัพย์สินของผู้เยาว์ดังต่อไปนี้ ผู้ใช้อำนาจปกครองจะกระทำมิได้ เว้นแต่ศาลจะอนุญาต (๑) ขาย แลกเปลี่ยน ขายฝาก ให้เช่าซื้อ จำนอง ปลดจำนอง หรือโอนสิทธิจำนอง ซึ่งอสังหาริมทรัพย์หรือสังหาริมทรัพย์ที่อาจจำนองได้ (๒) กระทำให้สุดสิ้นลงทั้งหมดหรือบางส่วน ซึ่งทรัพยสิทธิของผู้เยาว์อันเกี่ยวกับอสังหาริมทรัพย์ (๓) ก่อตั้งภาระจำยอม สิทธิอาศัย สิทธิเหนือพื้นดิน สิทธิเก็บกิน ภาระติดพันในอสังหาริมทรัพย์ หรือทรัพยสิทธิอื่นใดในอสังหาริมทรัพย์ (๔) จำหน่ายไปทั้งหมดหรือบางส่วนซึ่งสิทธิเรียกร้องที่จะให้ได้มาซึ่งทรัพยสิทธิในอสังหาริมทรัพย์ หรือสังหาริมทรัพย์ที่อาจจำนองได้ หรือสิทธิเรียกร้องที่จะให้ทรัพย์สินเช่นว่านั้นของผู้เยาว์ปลอดจากทรัพยสิทธิที่มีอยู่เหนือทรัพย์สินนั้น (๕) ให้เช่าอสังหาริมทรัพย์เกินสามปี (๖) ก่อข้อผูกพันใด ๆ ที่มุ่งให้เกิดผลตาม (๑) (๒) หรือ (๓) (๗) ให้กู้ยืมเงิน (๘) ให้โดยเสน่หา เว้นแต่จะเอาเงินได้ของผู้เยาว์ให้แทนผู้เยาว์เพื่อการกุศลสาธารณะ เพื่อการสังคม หรือตามหน้าที่ธรรมจรรยา ทั้งนี้ พอสมควรแก่ฐานานุรูปของผู้เยาว์ (๙) รับการให้โดยเสน่หาที่มีเงื่อนไขหรือค่าภาระติดพัน หรือไม่รับการให้โดยเสน่หา (๑๐) ประกันโดยประการใด ๆ อันอาจมีผลให้ผู้เยาว์ต้องถูกบังคับชำระหนี้หรือทำนิติกรรมอื่นที่มีผลให้ผู้เยาว์ต้องรับเป็นผู้รับชำระหนี้ของบุคคลอื่นหรือแทนบุคคลอื่น (๑๑) นำทรัพย์สินไปแสวงหาผลประโยชน์นอกจากในกรณีที่บัญญัติไว้ในมาตรา ๑๕๙๘/๔ (๑) (๒) หรือ (๓) (๑๒) ประนีประนอมยอมความ (๑๓) มอบข้อพิพาทให้อนุญาโตตุลาการวินิจฉัย

A person exercising parental power cannot enter into any of the following juristic acts with regard to the property of the minor except with permission of the Court; 1. selling, exchanging, sale with right of redemption, letting out property on hire-purchase, mortgaging, releasing mortgage to mortgagor or transferring the right of mortgage on immovable property or on mortgageable movable property; 2. extinguishing the whole or a part of real right of the minor on immovable property; 3. creating servitude, right of inhabitation, right of superficies, usufruct or any charge on immovable property; 4. disposing of the whole or a part of the claim the purpose of which is to create real right on immovable property or on mortgageable property, or the claim the purpose of which is to have a real right on such property of the minor relieved; 5. letting immovable property for more than three years; 6. creating any commitments the purpose of which is to achieve the objective as provided in (1), (2) and (3); 7. making a loan of money; 8. making a gift, except out of the income of the minor on the minor’s behalf for charitable, social or moral purposes, and suitable to the minor’s condition in life; 9. accepting a gift subject to any condition or charge, or refusing a gift; 10. giving guarantee by any means whatsoever which may cause the minor to be compelled to perform an obligation or to enter into other juristic act, as requiring the minor to perform an obligation to other person or on behalf of other person; 11. making benefit out of the property other than those provided in Section 1598/4 (1), (2) or (3) 12. making a compromise; 13. submitting a dispute to arbitration.

Section 1574 limits parental power over a child's significant assets, protecting the child from improvident parental decisions. Court approval (juvenile and family court) is needed before selling the child's land, gifting it, mortgaging, or settling a claim worth more than nominal amounts. This often arises in inheritance contexts: a child inherits land from a grandparent, and the surviving parent wants to sell to pay debts or relocate, the court must approve. The parent must show the transaction is in the child's interest, not the parent's.

Pourquoi cela est important en pratique

Pour les avocats : avant qu’un parent ne vende, n’hypothèque ou ne cède un bien immobilier hérité d’un enfant mineur, une requête auprès du tribunal est obligatoire ; tout transfert effectué sans autorisation est annulable à la demande de l’enfant. Pour les clients : vous ne pouvez pas vendre le bien de votre enfant sans l’autorisation du tribunal – cela protège l’enfant contre tout abus de confiance de la part de ses parents.

Historique législatif

L’article 1574 est applicable depuis la révision de la loi BE 2519. La loi sur l’égalité du mariage (n° 24, BE 2567), entrée en vigueur le 22 janvier 2025, n’a pas modifié le fond de l’article 1574, mais ses protections en matière de pouvoir parental s’appliquent de la même manière aux enfants de tous les couples mariés.

  1. Arrêt de la Cour suprême n° 533/2552 (2009)

    Le règlement d'une réclamation en responsabilité civile d'un enfant mineur sans l'approbation du tribunal est un acte couvert par l'article 1574 et est annulable.

    Lorsqu'un enfant mineur avait droit à une indemnisation pour délit, le parent agissant en tant que représentant légal devait obtenir l'approbation du tribunal avant de régler la réclamation ; le règlement sans approbation était un acte nécessitant une sanction judiciaire en vertu de l'article 1574 et était annulable.

  2. Arrêt de la Cour suprême n° 6595/2539 (1996)

    Un parent-tuteur qui gère des biens hérités pour des enfants mineurs doit obtenir l'approbation du tribunal en vertu de l'article 1574 avant de traiter ces biens.

    Une mère agissant en qualité de tutrice légale et d'administratrice de la succession a effectué des transactions sur les biens hérités des enfants mineurs ; le tribunal a constaté qu'elle était tenue, en vertu de l'article 1574, d'obtenir l'approbation du tribunal avant de traiter de la part des enfants dans la succession.
