เมื่อผู้รับบุตรบุญธรรมตายหรือมีการเลิกรับบุตรบุญธรรม ถ้าบุตรบุญธรรมยังไม่บรรลุนิติภาวะ ให้บิดามารดาโดยกำเนิดกลับมีอำนาจปกครองนับแต่เวลาที่ผู้รับบุตรบุญธรรมตาย หรือนับแต่เวลาที่จดทะเบียนเลิกการรับบุตรบุญธรรมตามมาตรา ๑๕๙๘/๓๑ หรือนับแต่เวลาที่ศาลมีคำพิพากษาถึงที่สุดให้เลิกการรับบุตรบุญธรรม เว้นแต่ศาลเห็นสมควรสั่งเป็นประการอื่น ในกรณีที่มีการตั้งผู้ปกครองของผู้เป็นบุตรบุญธรรมไว้ก่อนผู้รับบุตรบุญธรรมตาย หรือก่อนการเลิกรับบุตรบุญธรรม ให้ผู้ปกครองยังคงมีอำนาจหน้าที่เช่นเดิมต่อไป เว้นแต่บิดามารดาโดยกำเนิดจะร้องขอ และศาลมีคำสั่งให้ผู้ร้องขอเป็นผู้มีอำนาจปกครอง การเปลี่ยนผู้ใช้อำนาจปกครองตามวรรคหนึ่งหรือผู้ปกครองตามวรรคสองไม่เป็นเหตุเสื่อมสิทธิที่บุคคลภายนอกได้มาโดยสุจริตก่อนผู้รับบุตรบุญธรรมตายหรือก่อนจดทะเบียนเลิกการรับบุตรบุญธรรม ให้พนักงานอัยการเป็นผู้มีอำนาจร้องขอเพื่อให้ศาลมีคำสั่งเป็นประการอื่นตามวรรคหนึ่ง

On the death of the adopter, or on the dissolution of an adoption, if the adopted child is not yet sui juris, the natural parents recover parental power from the time of the adopter's death, or from the time the dissolution of the adoption is registered under Section 1598/31, or from the time the court's judgment dissolving the adoption becomes final, unless the court thinks fit to order otherwise.
Where a guardian of the adopted child was appointed before the adopter's death, or before the dissolution of the adoption, that guardian continues to have the same powers and duties, unless the natural parents apply to the court and the court orders that the applicants shall exercise parental power.
A change of the person exercising parental power under paragraph one, or of the guardian under paragraph two, does not prejudice rights acquired in good faith by a third person before the adopter's death or before the dissolution of the adoption was registered.
The public prosecutor has the power to apply to the court for an order otherwise under paragraph one.
