ถ้ามรดกตกทอดแก่ผู้เยาว์ หรือบุคคลวิกลจริต หรือบุคคลผู้ไม่สามารถจะจัดทำการงานของตนเองได้ตามความหมายแห่งมาตรา ๓๒ แห่งประมวลกฎหมายนี้ และบุคคลนั้นยังไม่มีผู้แทนโดยชอบธรรม หรือผู้อนุบาล หรือผู้พิทักษ์ เมื่อผู้มีส่วนได้เสีย หรือพนักงานอัยการร้องขอ ก็ให้ศาลตั้งผู้ปกครอง ผู้อนุบาล หรือผู้พิทักษ์ แล้วแต่กรณี

English translation
Where an estate devolves on a minor, on a person of unsound mind, or on a person incapable of managing his own affairs within the meaning of Section 32 of this Code, and that person has no legal representative, guardian or curator, the court shall, on the application of an interested person or of the public prosecutor, appoint a guardian, a curator or a custodian, as the case may be.
