ทายาทซึ่งเป็นผู้เยาว์ บุคคลวิกลจริต หรือบุคคลผู้ไม่สามารถจะจัดทำการงานของตนเองได้ตามความหมายแห่งมาตรา ๓๒ แห่งประมวลกฎหมายนี้ จะทำการดังต่อไปนี้ไม่ได้ เว้นแต่จะได้รับความยินยอมของบิดามารดา ผู้ปกครอง ผู้อนุบาล หรือผู้พิทักษ์ แล้วแต่กรณี และได้รับอนุมัติจากศาลแล้วคือ (๑) สละมรดก (๒) รับมรดกอันมีค่าภาระติดพันหรือเงื่อนไข

English translation
An heir who is a minor, a person of unsound mind, or a person incapable of managing his own affairs within the meaning of Section 32 of this Code may not do the following acts unless he has obtained the consent of his parents, guardian, curator or custodian, as the case may be, and the approval of the court: (1) renounce an inheritance; (2) accept an inheritance which is encumbered with a charge or subject to a condition.
