เมื่อคนในบังคับไทยจะทำพินัยกรรมในต่างประเทศ พินัยกรรมนั้นอาจทำตามแบบซึ่งกฎหมายของประเทศที่ทำพินัยกรรมบัญญัติไว้ หรือตามแบบที่กฎหมายไทยบัญญัติไว้ก็ได้ เมื่อทำพินัยกรรมตามแบบที่กฎหมายไทยบัญญัติไว้ อำนาจและหน้าที่ของกรมการอำเภอตามมาตรา ๑๖๕๘ ๑๖๖๐ ๑๖๖๑ ๑๖๖๒ ๑๖๖๓ ให้ตกแก่บุคคลดังต่อไปนี้ คือ (๑) พนักงานทูต หรือกงสุลฝ่ายไทย กระทำการตามขอบอำนาจของตน หรือ (๒) พนักงานใด ๆ ซึ่งมีอำนาจตามกฎหมายของต่างประเทศนั้น ๆ ที่จะรับบันทึกข้อแจ้งความไว้เป็นหลักฐานได้

English translation
Where a Thai national makes a will in a foreign country, that will may be made either in the form prescribed by the law of the country where it is made, or in the form prescribed by Thai law.
Where it is made in the form prescribed by Thai law, the powers and duties of the district officer under Sections 1658, 1660, 1661, 1662 and 1663 are exercised by:
(1) a Thai diplomatic or consular officer, acting within the scope of that officer's authority; or
(2) any official who, under the law of that foreign country, has authority to receive a declaration and record it as evidence.

มาตรา 1667 ให้คนในบังคับไทยที่อยู่ต่างประเทศเลือกแบบพินัยกรรมได้สองทาง คือแบบตามกฎหมายของประเทศที่ทำพินัยกรรมนั้น หรือแบบตามกฎหมายไทย ถ้าเลือกแบบไทย อำนาจและหน้าที่ที่กฎหมายกำหนดให้กรมการอำเภอทำตามมาตรา 1658 1660 1661 1662 และ 1663 ย่อมตกแก่พนักงานทูตหรือกงสุลฝ่ายไทยซึ่งกระทำการตามขอบอำนาจของตน หรือพนักงานของต่างประเทศซึ่งมีอำนาจตามกฎหมายของประเทศนั้น ในทางปฏิบัติ ผู้ทำพินัยกรรมควรพิจารณาว่าแบบใดจะพิสูจน์ได้ง่ายกว่าเมื่อต้องนำพินัยกรรมมาใช้ในประเทศไทย และควรแยกเรื่องแบบของพินัยกรรมตามมาตรานี้ ออกจากข้อห้ามเรื่องผู้รับทรัพย์ตามพินัยกรรมเป็นพยานตามมาตรา 1653
